High Court bans disclosure of unborn baby’s gender

The High Court has delivered a landmark verdict to stop the unethical practice of determining and disclosing the gender of unborn babies. The court directed that the gender of a fetus can no longer be revealed.

On Monday (11 May), the full text of the verdict issued by a High Court bench comprising Justice Naima Haider and Justice Kazi Zinat Hoque was published. Earlier, on 25 February 2024, the court had announced a short verdict.

In its ruling, the court said determining and disclosing the gender of unborn children encourages discrimination against women, increases the tendency of female child killings, disrupts social balance and goes against constitutional rights.

The court observed that such practices violate women’s dignity, equality and right to life. It also said the practice breaches international human rights obligations.

The High Court further stated that Bangladesh had long lacked effective control, monitoring and accountability measures regarding this issue. The court said preparing a guideline alone is not enough. Without implementable policies, digital monitoring and an effective regulatory system, unethical activities such as determining and disclosing fetal gender cannot be stopped.
